Below we present our terms and conditions
I. Preliminary Provisions
The owner of the Online Store is: “Power Canvas spółka z ograniczoną odpowiedzialnością” with its registered office in Kraków, 30-701, at ul. Zabłocie 39, entered in the register of entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register, under the identification number NIP: 6751524327, REGON: 362516750, e-mail: kontakt@powercanvas.pl (the “Administrator”). To use the Online Store, including browsing the Goods available in the Online Store’s assortment and placing orders, a device (e.g. a computer) with Internet access and an Internet browser (Safari, Chrome, Internet Explorer, Firefox, or Opera) is required. In order to register and place orders, the Client must have an active e-mail account. The Clients of the Online Store may be adults who have at least limited legal capacity, as well as legal persons or organizational units without legal personality, provided they have legal capacity and the capacity to perform legal actions.
II. Definitions
Business days – all days of the week from Monday to Friday, excluding public holidays and Saturdays;
Client – any person who in any way uses the Online Store;
Cart – part of the Online Store where the Client specifies the order details such as: Client data, ordered Goods, delivery address, invoice data, delivery method, payment method, and other information necessary for order fulfillment;
Newsletter – commercial information concerning the Power Canvas brand, in particular regarding Goods, news, promotions, etc.;
Online Store – the IT platform managed by the Administrator, enabling the placing of orders for Goods, operating at: www.powercanvas.com and www.powercanvas.pl;
Goods – products that can be ordered in the Online Store, manufactured according to the Specification (personalized);
Specification – all guidelines provided by the Client in the message referred to in Chapter III section 5 of the Terms and Conditions, or agreed with the Client on the basis of the regulation of Chapter III section 7 letter b) of the Terms and Conditions, containing the requirements regarding the method of manufacturing the Goods according to the Client’s individual needs, which may include one or more of the following elements: guidelines regarding the model(s) of the entire Goods covered by the order or its individual items; presentation of the graphic design that is to be applied to all models of the Goods covered by the order or to their individual copies.
III. Ordering Rules
Before placing an order in the Online Store, the Customer should familiarize themselves with these Terms and Conditions. Information about Products available in the Online Store's assortment does not constitute an offer within the meaning of the Civil Code. Information about Products provided on the Online Store's website constitutes an invitation to submit offers by Customers. By placing an order in the Online Store, the Customer makes an offer to conclude a sales agreement (purchase) for the selected Product. The conclusion of the sales agreement requires the Customer to place an order, followed by the Online Store confirming the acceptance of the order for execution after verifying the possibility of fulfilling the order according to the Specification. Orders in the Online Store can be placed 7 days a week, 24 hours a day, while their execution takes place on Business Days. The Customer can place an order in the Online Store by: sending an email to kontakt@powercanvas.pl, sending an electronic message using the contact form available on www.powercanvas.pl, which should include, in particular: the delivery address and method, the quantity of the Product indicating the number of pieces of each model of the Product, and the Product Specification. When placing an order, the Customer has the option to present guidelines specified in Chapter II point 6 letter b) of the Terms and Conditions in the Specification or to use the service of creating a graphic design applied to the Product by a graphic designer cooperating with the Online Store. The cost of the graphic design service is included in the product price, provided that the minimum order is met. Within 48 hours of receiving the message, the Administrator will provide a price estimate for the order, present the proposed execution date, and confirm the guidelines contained in the Specification, possibly making arrangements. After confirming the guidelines and agreeing on the Specification, the Administrator accepts the order. The order pricing is done individually, depending on the complexity, quantity of the Product, model, and type of graphic design. The stated price includes VAT unless otherwise specified and does not include shipping costs. The Customer can choose to pay "cash on delivery" or by bank transfer.
IV. Order Fulfillment
Order fulfillment takes place within the timeframe agreed upon with the Client, no later than 15 or 21 business days from the sending of the order confirmation. The Administrator promptly confirms the acceptance of the order for fulfillment via email, within a maximum of three days from the confirmation of the Specification or receipt of payment. In the event that it is not possible to fulfill all or part of the order according to the Specification, the Administrator informs the Client via email. The Client then decides whether to proceed with part of the order or to cancel the entire order. The Client can change or cancel the order until the fulfillment process begins. In the case of order cancellation with prepayment, the Administrator refunds the paid amount within three business days. Goods are delivered within 15 days (in Poland) or 21 days (abroad). In the case of payment by bank transfer, the order is accepted after the payment is credited.
V. Withdrawal from the Contract
A consumer may withdraw from the contract within 14 days of receiving the item, without providing a reason. The customer submits a withdrawal statement in accordance with Article 27 of the Consumer Rights Act. In the event of withdrawal, the customer should return the goods to: Power Canvas sp. z o. o., ul. Zabłocie 39, 30-701 Kraków, within 14 days. The right of withdrawal does not apply to goods made to specifications. In the event of withdrawal, the Administrator will refund all payments, but the return costs are borne by the customer.
VI. Complaints
The Administrator undertakes to deliver Goods free from defects and is liable if the goods have a physical or legal defect, in accordance with the Civil Code. Complaints can be submitted in person, by email (kontakt@powercanvas.pl), or by mail to the Administrator's address. Complaints are processed within 14 days, and the Customer has the option to use out-of-court methods for handling complaints.
VII. Personal Data
The Administrator is the controller of personal data provided by Clients in connection with the fulfillment of orders. Personal data is used solely for the purpose of fulfilling orders in accordance with legal regulations and the Privacy Policy (Appendix No. 2). The Client has the right to access, correct, modify, and request the deletion of their data.
VIII. Newsletter
The Client may consent to receive the Newsletter from the Administrator at the specified email address. The Client may unsubscribe from the Newsletter at any time.

XII. Final Provisions
The Administrator holds copyright or the appropriate license for the images and content on the site. Copying without the Administrator's consent is prohibited. In the case of producing Goods according to the Client's Specifications, the Client is responsible for ensuring that the graphic design does not infringe on the rights of third parties. The names of the Goods may be legally protected. In matters not regulated, Polish law applies. Any disputes will be resolved by the court competent for the Administrator's registered office.
Notice on Withdrawal from the Contract
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the moment you take possession of the item. To exercise this right, you must inform Power Canvas sp. z o. o. at ul. Zabłocie 39, 30-701 Kraków, email: kontakt@powercanvas.pl, by means of a clear statement. You may use the withdrawal form template, but it is not mandatory.
Effects of withdrawal from the contract
In the event of withdrawal from the contract, the Administrator will refund all payments received (including delivery costs, unless additional costs arise from the chosen delivery method). The refund will be made using the same payment methods used in the original transaction. We may withhold the refund until we receive the item or proof of its return.
